What Should I Expect From My Malpractice Lawyer?

Florida Legal Malpractice > Legal Malpractice Questions > What Should I Expect From My Malpractice Lawyer?

There are four things you should expect from your lawyer: honesty, advocacy, diligence, and communication. Your lawyer is your advocate, and you should expect your lawyer at all times to act in your best interest, within the bounds of professionalism and the law.

You should expect your lawyer to be honest. Your lawyer will not  coach you, or allow you, to lie or conceal evidence.  And your lawyer will also be honest with you at all times.  While your lawyer is an advocate for your position, it is also his or her job to be honest with you about the strengths and weaknesses of your case.

It is not doing a lawyer’s job to always be a cheerleader; your lawyer also has to keep you apprised of the negative news which comes in from time to time in any case.

You should expect your lawyer to be diligent in pursuing your case. Yours will not be the only case your lawyer has, and sometimes there are things your lawyer will have to wait for, like a hearing time or a trial date set by the judge, or a discovery schedule which is not solely in one party’s control. But when it can reasonably be done, your lawyer should be pushing your case along to its conclusion expeditiously.

Finally, you should expect your lawyer to communicate with you. You should be kept aware of the progress of the case regularly, and your lawyer should be available to answer your questions and seek your instructions from time to time.

If your lawyer is trying another lawsuit or away on a deposition trip, he or she may not be able to return your telephone call immediately. Someone else from the office should return your call if your lawyer cannot, and your lawyer should always return your call eventually. If he or she does not, you should let him know that you expect that.
